Welcome to PVF Depot. These Terms of Service (“Terms”) govern your access to and use of our website, online store, and related services (collectively, the “Services”). PVF Depot (“we”, “us”, “our”) operates this site and store, which are hosted by Shopify. By visiting or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1. Access and Account

You represent that you are at least the age of majority in your jurisdiction and you consent to any minor dependents using the Services on devices you own or manage. You may be asked to provide information (e.g., email, billing, payment, and shipping details) and you warrant such information is current, accurate, and complete. You are solely responsible for safeguarding your account credentials and all activity under your account. You may not transfer, sell, assign, or license your account.

2. Our Products

We strive to present accurate product information. However, colors and appearance can vary by device and settings. We do not warrant that products will meet your expectations or appear exactly as rendered online. Product descriptions, specifications, and availability may change without notice. We may discontinue products or limit quantities by person, region, or jurisdiction.

3. Orders

When you place an order, you make an offer to purchase. We may accept or decline any order at our discretion. Your order is accepted only after we confirm and process your payment. Please review your order carefully before submitting; cancellations may not be possible once accepted. If we decline or modify an order, we will attempt to notify you using the contact details provided at checkout. Your purchases are subject to our Return & Refund Policy. You represent that purchases are for your own use and not for commercial resale or export.

4. Prices and Billing

Prices, discounts, and promotions may change without notice. The price charged is the price in effect at checkout and shown in your confirmation email, unless otherwise stated, exclusive of applicable taxes and fees. Online prices may differ from other channels. Promotional offers may be governed by separate terms that control in the event of a conflict. You agree to provide current and accurate billing information and authorize us to charge all amounts due, including taxes and any shipping or handling when applicable.

5. Shipping and Delivery

Standard shipping cost is included in listed prices within the continental United States; processing typically takes 1–2 business days and delivery typically takes 3–5 business days after dispatch. Delivery times are estimates and not guaranteed. Title and risk of loss pass to you upon transfer to the carrier. For details, see our Shipping Policy.

LTL Appointments & Contact Details. For LTL freight shipments, carriers require a valid recipient phone number to schedule delivery. You must provide accurate recipient phone and email at checkout. Delivery delays or redelivery fees caused by inaccurate contact information are the customer’s responsibility.

6. Intellectual Property

The Services and all related content (including trademarks, text, images, graphics, audio/video, and their arrangement) are owned by PVF Depot or its licensors and are protected by applicable laws. You may use the Services for personal, non-commercial purposes only. Except as permitted by law or with our prior written consent, you may not reproduce, modify, distribute, display, or create derivative works from the Services or content. PVF Depot names, logos, and marks are our trademarks. Third-party names and marks are the property of their respective owners.

7. Optional Tools

We may provide access to third-party tools on an “as-is” and “as-available” basis without warranties or endorsements. Your use is at your sole risk and subject to those third parties’ terms. Future features released through the Services are also subject to these Terms.

8. Third-Party Links

The Services may link to third-party websites or include third-party materials. We are not responsible for examining or evaluating such content and assume no liability for your use of it. Review the applicable third-party policies before transacting. Any questions or complaints regarding third-party products or services should be directed to the third party.

9. Relationship with Shopify

Our store is hosted by Shopify. Your sales transactions are with PVF Depot, not Shopify. By using the Services, you acknowledge that Shopify is not responsible for sales between you and PVF Depot and you release Shopify from related claims as permitted by law.

10. Privacy

Personal information collected through the Services is governed by our Privacy Policy. Because our store is hosted by Shopify, certain data processing is handled by Shopify in accordance with Shopify’s Privacy Policy.

11. Feedback

If you submit reviews, ideas, or feedback (“Feedback”), you grant us a worldwide, perpetual, sublicensable, royalty-free license to use, reproduce, modify, publish, and display such Feedback for any lawful purpose. You represent that you have the rights to grant this license and that your Feedback complies with these Terms and applicable law. We may monitor, edit, or remove unlawful or objectionable content at our discretion.

12. Errors, Inaccuracies, and Omissions

Information on the Services may occasionally contain errors or omissions (e.g., typographical, pricing, availability). We reserve the right to correct, update, or cancel orders if information is inaccurate, at any time and without prior notice.

13. Prohibited Uses

You may use the Services only for lawful purposes. You may not, directly or indirectly: violate laws; infringe intellectual property; harass or harm others; transmit misleading, illegal, or malicious content; send spam; impersonate others; collect others’ personal information without consent; or interfere with or circumvent security features. We may suspend or terminate access for violations.

14. Termination

We may suspend or terminate your access to the Services at any time in our discretion. Sections intended to survive termination (including, without limitation, Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, and Privacy) will continue to apply.

15. Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED BY PVF DEPOT IN WRITING, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant uninterrupted, timely, secure, or error-free operation. Some jurisdictions do not allow certain disclaimers; if so, they may not apply to you to that extent.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PVF DEPOT AND ITS OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOST PROFITS, REVENUE, DATA, OR REPLACEMENT COSTS) ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

17. Indemnification

You agree to indemnify and hold harmless PVF Depot and our affiliates, officers, employees, agents, contractors, licensors, and service providers from claims, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, violation of law, or misuse of the Services. We may control the defense and you will cooperate at your expense.

18. Severability

If any provision of these Terms is unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remainder will continue in full force.

19. Waiver; Entire Agreement

Our failure to enforce any right is not a waiver. These Terms, together with posted policies (including the Privacy, Shipping, and Return & Refund Policies), constitute the entire agreement between you and us regarding the Services.

20. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without notice.

21. Governing Law

These Terms and any disputes arising out of or related to the Services are governed by the laws of the State of California, without regard to conflict of laws principles. You consent to exclusive jurisdiction and venue in the state and federal courts located in or with jurisdiction over San Bernardino County, California.

Headings are for convenience only and do not affect interpretation.

23. Changes to These Terms

We may update these Terms by posting a revised version on this page. Material changes will be notified as required by law and become effective on the date specified. Your continued use of the Services after changes become effective constitutes acceptance.
